Deprivation of Liberty Safeguards (DoLs)
Deprivation of Liberty Safeguards or DoLS ensure people who cannot consent to their care arrangements in a care home or hospital are protected if those arrangements deprive them of their liberty. Arrangements are assessed to check they are necessary and in the person's best interests.
The Law Society's understanding when someone is deprived of their liberty (opens new window) guidance document was updated in March 2024 and draws together the assistance that can be found in the case law and from the practical experience of the authors. It includes an overview of the legal framework, including the special considerations relating to those under 18.
